In accordance with article 13 of the General Data Protection Regulation ( Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free circulation of such data), here at the Consejo Superior de Colegios de Arquitectos de España (CSCAE) we are committed to protecting the information we deal with, not only for the purpose of due compliance with the body of rules by which we are regulated but because of the confidential nature of the personal data entrusted to us, specifically because of the information we receive on our website.

What data do we gather?

Data that, as the case may be, are supplied by users may be processed by the Consejo Superior de Colegios de Arquitectos de España (CSCAE) in its capacity as the party responsible for the processing, and which are at all times held and processed in European territory.

WHY DO WE PROCESS YOUR DATA?

At the CONSEJO SUPERIOR DE LOS COLEGIOS DE ARQUITECTOS DE ESPAÑA we process the data that we are provided with by the interested party with a view to dealing with different activities arising out of specific procedures. In this way, we will use your data for carrying out some of the following actions:

  • Arranging for associate members to take training courses
  • Correctly managing their participation in competitions organised by the Consejo Superior de Colegios de Arquitectos de España

WITH WHAT LEGITIMATION DO WE PROCESS YOUR DATA?

The processing of your data for dealing with subscription to the newsletter, participation in competitions or taking online training courses is based on your consent when providing them at the time of subscribing or joining.

The processing of data for sending out information is based on the legitimate interest on the part of the Consejo Superior de Colegios de Arquitectos de España (CSCAE) in keeping up a line of communication that enables subscribers to have ongoing training in their professional sphere. This interest is in line with the statutory obligation that this General Council has, as well as the duties that correspond to it in accordance with art.6 of Royal Decree 129/2018, of 16 March, whereby the General Statutes of professional associations of architects and of their Higher Council are approved, to look after their members by organising activities and common services of interest for members.

When sending out information responds to the exercise of public powers of the Council, the processing necessary for that purpose will be based on fulfilling its public interest mission or on exercising the public powers that correspond to the Council.

Lastly, the Consejo Superior de Colegios de Arquitectos de España (CSCAE) has the legal obligation necessary to process the data of users who request the exercise or defence of claims in compliance with section 9 in relation with section 5 of Act 2/1974 of 13 February on professional associations.

  • Enhancing collegiate interests: fulfilment of a mission that is in the public interest or in the exercise of public powers of the person responsible
  • Managing the data protection rights of interested parties; legal obligation
  • Accounting, fiscal, administrative and invoicing management and collection of membership fees from professional associations of architects: fulfilment of a mission in the public interest or in the exercise of the public powers of the person responsible
  • Recording claims, complaints, reports in order to control their processing and resolution. Disciplinary professional ethics-based control: fulfilment of a mission in the public interest or in the exercise of public powers of the person responsible
  • Fiscal, accounting and administrative management with professional collaborators, commission agents, etc.: execution of a contract and/or pre-contract.
  • Fiscal, accounting and administrative management with providers. Management and processing of contracting and expenditure dossiers with providers: execution of contract and/or pre-contract and legal obligation.
  • Processing providers /collaborators-prescribers’ data in order to respond to third-party debt requirements (trade credit embargoes); legal obligation.
  • Processes for finding, assessing and selecting candidates: consent of the interested party.
  • Keeping and publishing the census of architects according to article 10 of Act 2/1974 of 13 February on Professional Associations. Historical and statistical purposes. Fulfilment of a mission that is in the public interest or in the exercise of public powers of the person responsible
  • Keeping and publishing the register of professional services firms according to Act 2/2007 of 15 March on Professional Services Firms [sociedades profesionales]: fulfilment of a mission that is in the public interest or in the exercise of public powers of the person responsible

As regards the legitimation basis referenced, you are under the obligation to provide the personal data; in the event that you do not provide your personal details, it will not be possible to execute your contract, comply with the legal obligations or those derived from the public powers.

WHOM WILL YOUR DATA BE PASSED ON TO?

The Consejo Superior de Colegios de Arquitectos de España (CSCAE) will not pass on the data that you have provided us with, barring legal obligation to do so.

HOW LONG WILL WE KEEP YOUR DATA?

The data will be kept for as long as essential according to the purpose for which they were provided or gathered, without prejudice to, as the case may be, exercising your right to their erasure.

In relation with the processing necessary for sending out information, we will keep your data in the system unless you ask us to erase it and revoke your consent.

WHAT ARE YOUR RIGHTS?

Interested parties are entitled to access their personal data and ask for inaccurate data to be corrected or, as the case may be, to be erased when, among other reasons, the data are no longer necessary for the purposes for which they were gathered.

In certain circumstances, interested parties may request restriction of the processing of their data, in which case we will only keep them for exercising or defending claims.

In certain circumstances and for reasons to do with their particular situation, interested parties may oppose the processing of their data.
